I’m writing you today because I believe it is time for an overhaul of Virginia’s civil asset forfeiture laws.
Civil asset forfeiture laws allow law enforcement to take and keep property – regardless of whether or not the owner has been found guilty of a crime. Under these laws, the government can take your home, business, cash, car or other property on the mere suspicion that it is somehow connected to criminal activity.
This year, Virginia lawmakers had the opportunity to pass HB 900, a bill that would have ended the unconstitutional practice of civil asset forfeiture in our commonwealth. Unfortunately, the bill failed and the due process rights of Virginians remain in jeopardy.
I am urging you to push for civil asset forfeiture legislation because our commonwealth deserves better and I believe the rights of every American citizen should be protected until they are found guilty of a crime.
